Francis Cardinal George, one of the great theologian bishops of the American episcopate, issued a letter on a piece of pending legislation in the state of Illinois. The focus of the letter was on the teaching of the natural law, and why adherence to the natural law required opposition to the proposed legislation. In response, a well-known law professor at a prestigious secular [End Page 710] law school in the state wrote a public response for an online political website. The focus of his argument was to criticize the notion of natural law according to his understanding of the teaching of St. Thomas Aquinas. It is not necessary to describe the details of his argument, other than to say it tended to understand natural law as mere naturalism that evinced a fairly glaring misreading of the Angelic Doctor. That is, the secular legal scholar argued, in essence, that since the activity in question was observable by animals in nature, that it was therefore part of the natural law, and could be defended as a right. To this, a Thomistic sed contra is perhaps the most fitting response.As this story makes clear, there is a great ignorance of what constitutes the natural law in the secular consciousness, even among the most respected of secular legal scholars, to say nothing of the application of the natural law to the juridic world of law and politics. Perhaps the last hurrah of natural law, at least in the American public consciousness, was then Sen. Joseph Biden’s famous grilling of Supreme Court nominee Clarence Thomas on the subject in 1991. Since then, legal positivism has become nearly universal, divorcing legal norms from any realistic understanding of a common human nature. It has become the dominant ideology in America’s legal academies, even if some adherents of natural law remain in positions of authority in the judicial system.Although it has faded from the world of secular law in the United States, the tradition of natural law has retained a firm hold in Catholic thought, especially by that religious order dedicated to the teachings of its most brilliant adherent, St. Thomas. Not only Thomistic natural law, but proponents of the so-called new natural law continue to provide a vibrant source of debate and insight into the understanding of the natural law in evaluating the goodness of human action. Pope John Paul II’s famous encyclical Veritatis Splendor represents the magisterial commitment to the natural law approach in moral thinking, even if some might believe that commitment has weakened in recent years.To a lesser degree, there has remained a strong current of natural law thinking within the currents of legal philosophy in canon law, even if the precise connection between natural law and its juridic instantiation has not always been the focus. Among recent ecclesiastical legal theorists, arguably the most influential proponent of a robust natural law approach to legal philosophy was the Spanish canonist Javier Hervada Xiberta, and especially his Introducción crítica al derecho natural, currently in its tenth Spanish edition. A disciple of Jose Maria Escriva’s Opus Dei movement, Hervada was a long-serving and internationally respected dean of the School of Law in Navarre. Through his teaching and the various journals he founded, he insisted on the link between law and justice—lex and ius. Hervada was firmly convinced of the realism of law: law is nothing less than the ipsa res iusta. That notion of ius was not simply an idea, but recognized a real relationship of debt and obligation between persons. "Justice as the Living Good offers a comprehensive reading of Hegel's social and political philosophy. Two hundred years after the publication of his Philosophy of Right, Hegel's theory of justice remains a viable alternative to the social contract tradition in modern political theory. Hegel's Value shows that underlying Hegel's claims about freedom and history is a theory of value grounded in our dual nature as living and self-conscious beings. While Hegel follows the modern tradition in basing his theory on the (...) free will, he departs from the tradition in emphasizing the expression of the will in valuable action. Hegel's Value argues for the expressive validity of practical inferences as the key to understanding the connection between value and a system of right. Through a close reading of key episodes in the Phenomenology of Spirit and of the entire Philosophy of Right, this study show how Hegel develops his account of justice through an inferentialist conception of reason. Hegel's Value traces the development of right from the basic conception of property rights to an inclusive conception that he calls simply the Good, and finally to a system of just institutions structured by "living" inferential relations. In this sacred space, several in attendance offered expressions regarding Mary’s impact on their life professionally and personally. (...) Monsignor Michael Hazard celebrated the mass of Christian Burial.Mary was born on March 28, 1941, in Detroit, Michigan, the oldest child of Clarence and Evangeline Reichling. As a young child, she aspired to becoming a physician and was quickly discouraged by others as this was viewed as a profession for men, not women. Her father, recognizing her talent and interest in music, continued to support her as she pursued her music studies, giving her a high level of confidence and skill in piano performance while still in high school.Her teaching career was launched after completing her undergraduate degree from Nazareth College, Kalamazoo, Michigan, August 5, 1966, her Masters in Music Education from Indiana University in 1969, and a Doctor of Music Education from Indiana University in 1991. They appeared at her studio door, dressed like Dan Aykroyd and John Belushi in the film, The Blues Brothers, as they were wearing long oversized trench coats, black overshoes, black felt crumpled hats, and dark sunglasses, carrying their violin cases, and looking unshaven and disheveled. Mary, seeing them, lost her composure and began to laugh uncontrollably as the two stood there in stoic silence. Regaining her composure, she directed them to their respective chairs in front of music stands, had them take out their violins, and the lesson began. Not only was she respected by these two men but also by all the children and young people in her academic care.Having completed her undergraduate and graduate studies, Mary maintained an intense interest in learning, especially in philosophy and neuroscience with a focus on concepts such as thought, imagination, emotion, movement, space, and time. She was fascinated by the relationship between the performer and the audience, with respect to emotion, images, and imagination. Research for her doctoral dissertation, which she titled, “Images of Imagination: A Philosophical Study of Imagination in Music with Application to Music Education,” is reflective of her interest and research in the neuroscience field. Mary was awarded the Dean’s Dissertation Prize, Indiana University and awarded first place in 1991 Outstanding Dissertation in Music Education, national competition sponsored by the Council for Research in Music Education.In 1991, Mary accepted a position in the Department of Music, University of Louisiana, Lafayette where she taught undergraduate and graduate students. She served as advisor to graduate students in the music education concentration as well as serving on students’ dissertation committees. Her commitment to students was exemplified by her availability, in spite of other commitments to the University and music community beyond the university. The AdS/CFT duality has been a source of several strong conceptual claims in the physics literature that have yet to be explored by philosophers. In this paper I focus on one of these: the extent to which spacetime geometry and locality can be said to emerge from this duality, so that neither is fundamental. I argue: that the kind of emergence in question is relatively weak, involving one kind of spacetime emerging from another kind of spacetime; inasmuch as there is (...) something conceptually interesting to say about the emergence of spacetime and locality , it is no different from that already well known to those within canonical quantum gravity; that at the core of AdS/CFT is an issue of representation and redundancy in representation. This paper argues that common social narratives about unhealthy eaters can cause significant damage to agency. I identify and analyze a narrative that combines a “control model” of eating agency with the healthist assumption that health is the ultimate end of eating. I argue that this narrative produces and enables four types of damage to the agency of those identified as unhealthy eaters. Due to uncertainty about what counts as healthy eating and various forms of prejudice, the unhealthy eater label (...) and its harms to agency are more likely to stick to some people than others and may reinforce patterns of oppression. I argue that fat people are especially vulnerable to this identification and the damage it can do. I then consider possible “counterstories” about unhealthy eaters, alternative narratives that might be less damaging to agency than the control narrative. I identify one promising counterstory but suggest that it may be limited when it comes to repairing damage to the agency of fat people. Overall, this paper illustrates some of the complex ways that healthism about eating affects agency, and emphasizes the ethical importance of the ways we think about and discuss eating and eaters. This paper contends that eating shapes the self; that is, our practices and understandings of eating can cultivate, reinforce, or diminish important aspects of the self, including agency, values, capacities, affects, and self-understandings. I argue that these self-shaping effects should be included in our ethical analyses and evaluations of eating. I make a case for this claim through an analysis and critique of the hypothesis that young women’s vegetarianism is a risk, sign, or “cover” for eating disorders or disordered eating. (...) After outlining the relevant empirical literature, I suggest that the evidence for this hypothesis is inconclusive. Given this uncertainty, we should consider the risks of making a mistake when accepting or rejecting this understanding of young women’s eating. I argue that these risks importantly include negative effects on the self, such as damage to moral and epistemic agency. Along with other potential consequences of mistakenly accepting the hypothesis, these effects give us reason to reject it pending more conclusive research. Overall, this paper offers a philosophical intervention into the debate over the relationship between vegetarianism and eating disorders while illustrating the ethical importance and relevance of eating as a self-shaping activity. This brief paper shows how an exact analogue of Einstein's original hole argument can be constructed in the loop representation of quantum gravity. The new argument is based on the embedding of spin-networks in a manifold and the action of the diffeomorphism constraint on them. The implications of this result are then discussed. I argue that the conclusions of many physicists working on loop quantum gravity---Rovelli and Smolin in particular---that the loop representation uniquely supports relationalism are unfounded.

The dominance of string theory in the research landscape of quantum gravity physics (despite any direct experimental evidence) can, I think, be justified in a variety of ways. Here I focus on an argument from mathematical fertility, broadly similar to Hilary Putnam’s ‘no miracles argument’ that, I argue, many string theorists in fact espouse in some form or other. String theory has generated many surprising, useful, and well-confirmed mathematical ‘predictions’—here I focus on mirror symmetry and the mirror theorem. These predictions (...) were made on the basis of general physical principles entering into string theory. The success of the mathematical predictions are then seen as evidence for the framework that generated them. I shall attempt to defend this argument, but there are nonetheless some serious objections to be faced. These objections can only be evaded at a considerably high (philosophical) price. (shrink)

This book provides a new interpretation of the ethical theory of G.W.F. Hegel.

This dissertation seeks to explicate the fundamental contributions of phenomenology to the philosophy of language as it is presently conceived in the Anglo-American tradition for which John Searle serves as the representative. They are the essence of language in the later essays of Martin Heidegger and the perspicacious description of the experience of speaking in Maurice Merleau-Ponty. ;After roughly describing the subjectivistic assumptions, the questions, and the goals of the philosophy of language in the works of Searle, the study proceeds (...) to explore how phenomenology's characteristic search for essences and concern for lived-experience can set it on a more circumspect path. ;The study elicits the following conclusions. Despite significant contrasts, there is a solid complementarity between Heidegger and Merleau-Ponty as phenomenologists concerned with the language phenomenon. Heidegger and Merleau-Ponty make substantial contributions to the philosophy of language. Specifically, its traditional subjectivistic assumptions are phenomenologically re-thought; answers to its customary questions are formulated from a pre-subjective and pre-objective perspective; and the traditional problem of how language and speaking can be creative is resolved. Finally, some of the concerns of a complete philosophy of language left unaddressed by Heidegger and Merleau-Ponty are itemized. (shrink)

Some communitarians about personhood hold that human communities are metaphysically antecedent to individual persons, and that personhood comes in degrees, and that one becomes a person through ethical maturation within a community. I offer a new communitarianism that also endorses those claims. It is based partly on certain African accounts of the person—primarily Menkiti’s account—and partly on Mark Johnston’s extraordinary argument that extremely good persons are literally at one with the human community itself. The theory’s concept of the person is (...) a novel understanding of the social self. I argue that the account helps to solve three puzzles to do with communitarian conceptions of personhood. One puzzle is about understanding the individual person as an individual. Another relates to the alleged metaphysical priority of communities over persons. And a third is a problem for the view that personhood is graded. (shrink)

Questions about the meanings of racialized representations must be included as part of developing an ethical game design practice. This paper examines the various ways in which race and racial contexts are repre-sented in a selected range of commercially available e-games, namely war, sports and action-adventure games. The analysis focuses on the use of racial slurs and the contingencies of historical re-representation in war games; the limited representation of black masculinity in sports games and the romanticization of ‘ghetto play’ in (...) urban street games; and the pathologization and fetishization of race in ‘crime sim’ action-adventure games such as True Crime: Streets of LA. This paper argues for, firstly, a continuous critical engagement with these dominant representations in all their evolving forms; secondly, the necessary inclusion of reflexive precepts in e-games development contexts; and thirdly, the importance of advocating for more diverse and equitable racialized representations in commercial e-games. This study presents scientific theories about the female body in Greece of the 5th and 4th centuries BC. It demonstrates the influence of cultural preconceptions on such theories, and of scientific theories on cultural attitudes.

This paper offers a defense of the practice of mindless eating. Popular accounts of the practice suggest that it is non-autonomous and to blame for many of society’s food related problems, including the so-called obesity epidemic and the prevalence of diet related illnesses like diabetes. I use Maureen Sie’s “traffic participation” account of agency to argue that some mindless eating is autonomous, or more specifically, agential. Insofar as we value autonomous eating, then, it should be valued. I also argue that (...) mindless eating can be substantively good: it can help us achieve valuable ends, like creating and maintaining community. Acknowledging the agency and value in mindless eating has both practical and ethical benefits. I contend that it can help us preserve the value in mindless eating while suggesting more effective ways to change it, and, by offering a new narrative about mindless eaters, may be less damaging to agency than popular narratives. In this essay collection, leading physicists, philosophers, and historians attempt to fill the empty theoretical ground in the foundations of information and address the related question of the limits to our knowledge of the world. Over recent decades, our practical approach to information and its exploitation has radically outpaced our theoretical understanding - to such a degree that reflection on the foundations may seem futile. But it is exactly fields such as quantum information, which are shifting the boundaries of the (...) physically possible, that make a foundational understanding of information increasingly important. One of the recurring themes of the book is the claim by Eddington and Wheeler that information involves interaction and putting agents or observers centre stage. Thus, physical reality, in their view, is shaped by the questions we choose to put to it and is built up from the information residing at its core. This is the root of Wheeler's famous phrase "it from bit." After reading the stimulating essays collected in this volume, readers will be in a good position to decide whether they agree with this view. (shrink)

This study examines the 3.5 m+ English-language original tweets that occurred during the 2011 Occupy Wall Street protests. Starting from previous research, we analyze how character terms such as “the banker,” “politician,” “the teaparty,” “GOP,” and “the corporation,” as well as concept terms such as “ethics,” “fairness,” “morals,” “justice,” and “democracy” were used by individual participants to respond to the Occupy Wall Street events. These character and concept terms not only allowed individuals to take an ethical stance but also accumulated (...) into a citizen’s narrative about social accountability. The analysis illustrates how the centrality of the different concepts and characters in the conversation changed over time as well as how the concepts ethics, morals, fairness, justice, and democracy participated within the conversation, helping to amplify the ethical attributes of different characters. These findings contribute to our understanding of how demands for social accountability are articulated and change over time. (shrink)

Joseph Heath states that our paper “misinterpret[s]” and so misrepresents his account. The present Commentary corrects the record. Our paper (Cohen and Peterson 2019) outlined Heath’s account on his own terms; it explained that Heath distances himself from consequentialism. But then we argued that Heath is mistaken and so offered a repaired version of the market failures approach. Our central concern, in the original paper and in this short Commentary, is showing that the economic argument for markets is at the (...) same time ethical, and then being more precise about the ethical consideration that does the work. It is a common practice for family members to bring food to hospitalized loved ones. However, in some cases, this food contravenes a patient's dietary plan. Such situations can create significant tension and distrust between health care professionals and families and may lead the former to doubt a family's willingness or ability to support patient recovery. This case‐study essay offers an ethical analysis of these situations. We draw on Hilde Lindemann's work to argue that providing food to family members is (...) an important way that families discharge their moral functions of caring for their members and holding them in their identities. When family members are hospitalized, other means of performing these functions are limited. Acknowledging the ethical importance of feeding family members alongside the medical need for dietary restrictions, we offer strategies for creative problem‐solving that center diet as a subject for shared decision‐making and regular, ongoing communication among health care professionals, patients, and families. In this paper I argue that Kant's claims about conscience in his moral writings of the 1790s reveal a fundamental instability in his moral philosophy. The central issue is the relationship between the moral law as the form of universality and the judgment of individuals about specific cases. Against Thomas Hill's claim that Kant has only a limited role for conscience, I argue that conscience has a comprehensive role in Kantian deliberation. I unpack the claims about conscience in the Metaphysics (...) of Morals to show that they describe conscience as both a basic act of self-consciousness and as an all-things-considered judgment. I outline the role of conscience in moral motivation, and argue that taken together Kant's writings about conscience reveal a way to rethink Kant's conception of the Fact of Reason. (shrink)

Lack of time is a commonly reported barrier to healthy eating, but a literal lack of time is only one way that time may compromise eating well. This article explores how the first-personal lived experience of time shapes and is shaped by eating. I draw upon phenomenology and feminist theory to argue that the dynamic relationship between eating and temporality matters for food ethics. Specifically, temporalities and related ways of eating can be better or worse vis-à-vis key ethical concerns. Though COVID-19 is not a foodborne illness, it has had significant impacts on eating around the world, including increases in food insecurity, dining restrictions and closures of restaurants, interruptions in supply chains, and rising food prices.
